Terms of Use

Welcome to Feedbackland! These Terms of Use ("Terms") govern your access to and use of the Feedbackland website, services, and software widget (collectively, "the Service"), operated by Feedbackland ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

1. The Service

Feedbackland is a platform that allows companies ("Customers") to collect, manage, and analyze user feedback through an embeddable widget. This includes feature requests, bug reports, comments, and upvotes submitted by end-users ("End-Users"). The Service also provides Customers with administrative tools for tracking feedback status and generating AI-powered insights.

2. Important Distinction: Hosted Service vs. Self-Hosted Software

Our business model involves two distinct offerings, and it is crucial to understand which terms apply to you:

  • Cloud-Hosted Service: These Terms of Use govern the use of our official, cloud-hosted version of Feedbackland, available at https://feedbackland.com.
  • Self-Hosted Software: The underlying open-source software is available for you to download, modify, and host on your own servers. Your use of the software code itself is governed by the GNU Affero General Public License v3.0 (AGPL v3.0), not these Terms of Use. If you run a modified version of the software as a publicly accessible service, the AGPL v3.0 requires you to make your modified source code available to your users.

3. User Accounts (Customers)

To use the administrative features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information.
  • Keep your password confidential and be solely responsible for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

4. User-Generated Content

You (and your End-Users) are responsible for any text, images, or other material you submit to the Service ("Content").

  • Ownership: You retain ownership of your Content.
  • License to Us: By submitting Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform the Content in connection with providing and improving the Service. This license is necessary for us to, for example, display feedback on your widget or use it to train our AI summarization models for your benefit.
  • Responsibility: You represent and warrant that you have the right to submit the Content and that it does not violate the law or the rights of any third party. We have the right to remove any Content that we believe violates these Terms.

5. Acceptable Use

You agree not to use the Service to:

  • Post any Content that is unlawful, harmful, defamatory, obscene, or infringing on intellectual property rights.
  • Harass, abuse, or harm another person.
  • Engage in spamming or transmitting unsolicited communications.
  • Attempt to gain unauthorized access to our systems or engage in any activity that disrupts or impairs the Service.
  • Reverse-engineer or decompile the cloud-hosted Service infrastructure. This does not limit your rights under the AGPL v3.0 for the self-hosted software.

6. Fees and Payment (Cloud-Hosted Service)

Certain features of the Service may be provided for a fee. You agree to pay all applicable fees for the subscription plan you select. All fees are non-refundable, except as required by law or as otherwise stated in your subscription plan. We reserve the right to change our prices with reasonable prior notice.

7. Termination

  • By You: You can terminate your account at any time by following the instructions within the Service.
  • By Us: We may suspend or terminate your access to the Service at any time, with or without cause, if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. We may delete your Content and account data, though some data may persist in backups for a period of time.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FEEDBACKLAND BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Governing Law

These Terms shall be governed by the laws of Belgium, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Belgium.

10. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide you with notice through the Service or by email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
