Welcome to Feedbackland. We, Feedbackland ("we," "us," or "our"), respect your privacy and are committed to protecting your personal data. This Privacy Policy will inform you how we look after your personal data when you use our Service and tell you about your privacy rights.

1. Important Information and Who We Are

This Privacy Policy applies to the cloud-hosted version of the Feedbackland Service.

Controller vs. Processor: Our role depends on the situation.

  • For our Customers (account holders): We act as the data controller for the personal data we collect from you to create and manage your account (e.g., your name, email, and payment information).
  • For End-Users (individuals providing feedback via the widget or standalone platform): Our Customer (the company whose website you are on) is the data controller. We act as a data processor on their behalf. We only process your data according to our Customer's instructions and our agreement with them.
  • Self-Hosted Software: If you use the self-hosted version of Feedbackland, the entity hosting the software is the sole data controller. This policy does not apply to self-hosted instances.

2. The Data We Collect About You

We may collect, use, store, and transfer different kinds of personal data about you which we have grouped together as follows:

  • Identity and Contact Data (Customers): Includes first name, last name, and email address.
  • Financial Data (Customers): Includes payment card details, which are processed securely by our third-party payment processor (e.g., Stripe) and are not held by us.
  • Technical Data: Includes internet protocol (IP) address, browser type and version, time zone setting and location, and other technology on the devices you use to access this Service.
  • Content Data (End-Users and Customers): Includes all feedback, comments, upvotes, and other content you submit through the Service. Our Customers determine what, if any, personal data (like name or email) is collected from their End-Users alongside the feedback.
  • Usage Data: Includes information about how you use our website and Service.

3. How We Use Your Personal Data

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • To provide and maintain our Service.
  • To process payments for our Customers.
  • To manage our relationship with you, including notifying you about changes to our terms or privacy policy.
  • To improve our Service, including training our AI models. All data used for AI training is anonymized to the fullest extent possible to protect privacy.
  • For security, fraud prevention, and to comply with legal obligations.

4. How We Share Your Personal Data

We do not sell your personal data. We may share your data with:

  • Service Providers: Companies that provide services on our behalf, such as payment processing, hosting (e.g., Vercel, AWS), and analytics.
  • Our Customers: All Content Data submitted by an End-User through a Customer's widget is shared with that Customer.
  • Legal Requirements: If required by law, we may disclose your information to public authorities.

5. Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way. We limit access to your personal data to those employees and third parties who have a business need to know.

6. Data Retention

We will only retain your personal data for as long as reasonably necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements.

7. Your Legal Rights

Under certain circumstances, you have rights under data protection laws (like GDPR) in relation to your personal data, including the right to access, correct, or erase your personal data.

If you are a Customer and wish to exercise these rights, please contact us. If you are an End-User, you should direct your request to the Customer (the data controller) whose feedback widget you used.

8. Children's Privacy

Our Service is not intended for children under the age of 16, and we do not knowingly collect data relating to children.

9. Changes to This Privacy Policy

We may update this policy from time to time. We will notify you of any changes by posting the new policy on this page and, if the changes are significant, by providing a more prominent notice (like an email notification).
